摘要
无论是在学术层面还是法律实务方面,传统工艺美术作品的著作权权属纠纷和侵权问题在实际创作和市场中长期存在,这是由传统工艺美术作品的创作和交易的复杂性决定的。基于此,通过分析传统工艺美术领域承揽、合作、所有权转移等法律关系下的著作权权属问题,再辅之以著作权登记、行业名誉损害赔偿等措施,可以破解传统工艺美术作品当前的著作权困境。
In terms of academy and legal practice, the copyright ownership disputes and infringement issues of traditional arts and crafts have existed for a long time in actual creation field and market. This is determined by the complexity of the creation and transaction of traditional arts and crafts.Based on this, the current copyright dilemma of traditional arts and crafts can be solved by analyzing copyright ownership issues under legal relations such as contracting, cooperation and ownership transfer and other measures like crafts field copyright registration and compensation of industry reputation damage of traditional arts and crafts.
