摘要
在积极构筑和健全中国社会信用体系的大环境中,民航旅客黑名单制度发挥着不可或缺的作用。但当前的民航旅客黑名单制度,在实践过程中存在着诸多问题,难以发挥应有的制度优势,尚不能完全满足信用民航和航空安全的双重需求。为此,建议可以以《中华人民共和国民用航空法》为基础,构建中国民航旅客黑名单二元制度,即应明确该制度的法律属性和依据,并鉴于双重需求之间的差异制定不同的程序规则,同时完善旅客的救济途径。
The blacklist of civil aviation passengers plays an indispensable role in the active construction of China’s social credit system.However,the current blacklist system of civil aviation passengers has many problems in practice,which makes it difficult to give full play to its institutional advantages and unable to meet completely the dual needs of civil aviation with credit and aviation safety.Therefore,it is suggested that a dual system of the blacklist of civil aviation passengers should be established based on the Civil Aviation Law of the People’s Republic of China.This means that the legal attributes and basis of this system should be clarified,and different procedural rules should be formulated in view of the great differences in dual needs,and remedy measures for passengers should be improved.
