摘要
网络直播带货作为以“互联网+”为基础的一种新型商品销售模式,逐渐地影响了普通群众的消费习惯。然而,直播带货中存在的问题也日益显露。其中比较典型的有:带货主播的法律地位模糊,缺乏专门性法律、执法部门的监管不力、带货产品存在虚假宣传及产品质量问题、网红主播涉嫌偷漏税问题等等。因此针对上述存在的问题,笔者建议力求法律规制要“对症下药”,精准解决直播带货中出现的问题,以维护好社会主义市场经济体系的安全与稳定,为直播带货这一新兴经济增长点的持续发展保驾护航。
As a new commodity selling mode based on“Internet+”,livestream shopping has changed people’s consumption habits.However,with the booming development of live streaming,many problems have also emerged,for example,the obscure legal stand of webcast host,a lack of professional legal guidance,the insufficient legal supervision,fake advertisement,poor quality of the good,tax evasion of the webcast host,and etc.Therefore,the purpose of this paper is to analyze the above-mentioned problems,put forward some proposals concerning the regulation from the legal level,and make every effort to guarantee a sustainable development of the live webcast economy,so as to safeguard the socialist market transaction security and stability.
