摘要
自家事审判改革以来,山东省泰安市两级法院通过创新家事审判工作机制、组建专业化审判团队、完善专业化审判机构和场所等举措对家事审判改革进行了有益的探索。但是在家事审判改革的过程中也发现了多元化解机制效果不明显,家事程序立法落后等问题。据此,文章以泰安法院进行家事审判改革试点以来的实际运行状况作为考察样本,分析改革过程中遇到的问题及解决方案,以期为我国的家事审判改革的完善路径提供有益借鉴。
Taking the operation of Tai’an people’s Court as a reference sample since the reform of family trial,the two-level courts of Tai’an City,Shandong Province have made beneficial exploration on the reform of family trial by innovating the working mechanism of family trial,establishing professional trial team,improving professional trial institutions and places and other measures.However,in the process of family trial reform,it is also found that the effect of diversified resolution mechanism is not obvious,and the legislation of family procedure is backward.Accordingly,this paper takes the actual operation of Tai’an court since the pilot of family trial reform as an investigation sample to analyze the problems and solutions encountered in the reform process,in order to provide a useful reference for the improvement path of family trial reform in our country.
