摘要
当前算法治理面临进程缓慢、实效不佳、理论分野的现实困境,“数字弱势群体”及“数字人权”概念的提出为算法治理提供了新的思路与方向。虽然通过发展人权法的具体制度来规制算法技术的路径值得追求,但人权从应有权利到实有权利的转变并非“一日之功”,从目前来看这种模式(或这种方法)难以缓解社会大众对于算法治理的迫切需求。基于人权标准的企业算法合规义务,通过整合现有的国际人权标准与企业合规机制以应对算法合规风险,具有改进算法治理模式、整合算法治理路径、降低企业经营风险、提升企业经济效益、促进人权保障与享有的工具价值。这种新型治理方式,通过数字企业自我约束、自我监督、自我披露,可以重塑人们对算法社会的信任,以算法技术、人、社会间的良性互动与共进发展塑造公正平等、包容向善、可持续的算法社会。
The current algorithmic governance is facing the real dilemma of slow progress,poor effectiveness and theoretical division.The concepts of“digital disadvantaged groups”and“digital human rights”provide new ideas for and directions to algorithmic governance.Although the path of regulating algorithmic technologies through the development of specific regimes of human rights law is worth pursuing,the transformation of human rights from ought to be value to actual rights is not a“one-day work”,and it is difficult to alleviate the public’s urgent need for algorithmic governance at present.The corporate algorithmic compliance obligation based on human rights standards is a“soft law tool”to deal with algorithmic compliance risks by integrating existing international human rights standards with corporate compliance mechanisms,which has the value as a tool of improving algorithmic governance models,integrating algorithmic governance paths,reducing corporate operational risks,enhancing corporate economic benefits,and promoting the protection and enjoyment of human rights.This new type of governance,through self-discipline,self-monitoring and self-disclosure by digital enterprises,could reshape people’s trust of the algorithmic society and realize a fair and equal,inclusive and good,and sustainable algorithmic society with the harmonious interaction and co-advancement among algorithm technology,human beings and society.
