摘要
当前中资企业承揽国际项目受文化理念差异、国际关系变化以及其他不可抗力影响导致项目合同终止方面的风险增加。面对可能发生的合同终止风险,项目承包方做好应对工作以保障企业权益、维护国家利益十分重要。本文以某大型央企国际工程项目合同终止事件为例,分析合同终止前准备、合同终止后应对的具体应对思路与策略,以期为类似项目提供参考借鉴。
Due to the impact of the factors arising out of differences on cultural concepts and international relation changes as well as majeure force while Chinese enterprise undertaking international engineering projects,the risks of project contract termination increase.Once contract terminates,it is important for the project contractor to well settle down to protect the rights and interests of the enterprise and safeguard the national interests.The paper takes the contract termination event of a large central enterprise international engineering project as an example,analyzes the specific response ideas and strategies of preparation before contract termination and response after contract termination,in order to provide reference for similar projects.
