摘要
根据《中华人民共和国宪法》和《中华人民共和国民法典》的相关规定,提出生态环境损害赔偿制度。环境行政处罚与生态环境损害赔偿在实践中有三种衔接模式:主动修复受损生态环境作为减轻环境行政处罚的依据、将生态修复机制适用于行政处罚案件、“行政处罚+生态修复”。在此过程中,两者也存在主体不协调、司法资源浪费、信息不对称、无法完全实现生态环境修复目的等问题;通过对问题的研判,提出主体之间协同、行政执法与司法相贯通、磋商程序与行政处罚相协同等对策,使生态环境损害赔偿制度的发展更加完善。
Based on the relevant provisions of the Constitution and the Civil Code,a compensation system for the damage to ecological environment is proposed and implemented.In practice,three modes have been developed to relate ecological environment damage compensation system to environmental administrative penalties:restoring the damaged ecological environment as the basis for mitigating environmental administrative punishment;applying the ecological restoration mechanism to administrative penalties;"administrative penalties plus ecological restoration".However,there are also problems such as incoordination among diff erent entities,waste of judicial resources,information asymmetry,and the inability to fully realize the purpose of ecological environment restoration.This article proposes suggestions such as synergizing entities,connecting administrative law enforcement with the judicial system,and coordinating negotiation process with administrative punishment.All this can help improve the development of compensation for ecological environmental damage.
