摘要
档案法治现代化是指运用法治思维和法治方式,秉持法治建设与社会物质生活条件基础和时代发展进程同向变化的理念,而开展的档案立法、执法、司法、守法等工作的动态过程。实现档案法治现代化,不仅应以习近平法治思想作为根本遵循,还要统筹档案法规体系的立改废释工作机制,改革档案行政执法机制,准确适用法律审理涉档案件的司法机制,并健全完善档案法律法规的普法机制。
The modernization of archival rule of law in China refers to the dynamic process of archival legislation,law enforcement,judicature,law-abiding and other work by using the thinking and mode of rule of law and adhering to the concept of changing in the same direction with the basis of social material living conditions and the development process of the era.To realize the modernization of the rule of law in archives undertaking,we should not only follow Xi Jinping’s thought on the rule of law,but also coordinate the work mechanism for the establishment,reform,abolition and interpretation of the archives legal system,reform the archives administrative law enforcement mechanism,accurately apply the law to the judicial mechanism for hearing archival cases,and improve the legal popularization mechanism of archival laws and regulations.
