摘要
应急物流运行机制作为应急管理系统的重要一环,能否发挥应有作用,法制顶层设计至关重要。本文旨在优化应急物流关联法制,助推物流运行路径在应急状态下的重塑与修正。并从物流环节与相应部门法的相互作用角度,通过理论与实践相结合的方法,综合运用规范分析法、功能分析法、比较分析法等对中国应急物流运行路径进行探讨,按照“应急物流现有运行模式存在的问题-现行法制对应急物流运行的制约——法制适应性优化”这一框架,提出了法制优化视野下中国应急物流运行的改进方案。
As an important part of emergency management system,whether the emergency logistics operation mechanism can play its due role or not,the top-level design of the law and policy is the key.This paper aims to optimize law and policy related emergency logistics,and promote the remodeling and correction of the logistics operation path in the emergency state.From the perspective of the interaction between the logistics link and the corresponding department law,through the combination of theoretical research and practical research,the operation path of China’s emergency logistics is discussed by using the normative analysis method,functional analysis method and comparative analysis method.According to the framework of"problems in the existing operation mode of emergency logistics-constraints of current laws and policies on the operation of emergency logistics-adaptability optimization of laws and policies",the improvement scheme of China’s emergency logistics operation was put forward from the perspective of law and policy optimization.
