摘要
职场竞争压力的加大和通信技术便捷性的提高,导致员工下班后仍要接听工作相关的电话、处理工作相关的邮件、在社交软件上接收并响应工作的现象非常普遍。通过实证研究我们发现,这种工作入侵至非工作领域的“隐形工时”延长危害了员工的身心健康。如果工作时间劳工标准将这部分工作入侵非工作领域、打扰员工正常家庭生活的“隐形工时”刨除在外,就违背了国际劳工组织保护员工身心健康、促进体面劳动的宗旨。因此,国际劳工组织应该将在非传统工作时间处理工作相关事务的时间纳入到工作时间以内,并推动各国政府根据本国国情和实际情况对工作入侵非工作领域的时间加以限制,明确工作时间的边界,鼓励员工拥有“断网权”,从而保障员工体面的劳动,促进员工身心健康,使之工作生活相平衡。
With the intensified pressure of workplace competition and the improvement of convenient communication technology,it is very common for employees to answer work-related calls,deal with work-related emails,and receive and respond to work on social software after work.Results of empirical research show that this invisible extension of working hours,which intrudes into nonwork areas,endangers employees’physical and mental health.If the standard working hours exclude the“invisible working hours”that intrude into the nonwork field and disturb employees’normal family life,it will violate the goal of the International Labour Organization to protect employees’physical and mental health and promote decent work.Therefore,the International Labour Organization should include the time for dealing with work-related affairs in non-traditional working hours into working hours,promote governments to limit the time when work intrudes into nonwork areas according to their national conditions and actual conditions,clarify the boundary of working hours,and encourage employees to have the“right to disconnect from the Internet”,so as to ensure their decent work and promote their physical and mental health as well as work-life balance.
