摘要
《民法典》调整着人们方方面面的生活,这与残疾人社会融合的全方位需求不谋而合。民法的全部内容都是残疾人全面融入社会的记载。在智力残疾人的权益保障上,《民法典》沿续了我国成年人监护的立法与实践,完善了对精神残疾者的特殊保护。在残疾人的婚姻权利上,《民法典》废止了禁婚条款,为残疾人的结婚权提供了全面的保障。对于残疾儿童财产权,《民法典》坚持了病残儿童享有法定继承的权利。为了残疾人更好地融入社会,《民法典》规定了“不得拒绝”的禁止性条款,为残疾人出行提供了坚实的法律保障。对于残疾赔偿金和辅助器具,《民法典》损害赔偿篇进行了专门的规定。《民法典》在立法上的这些亮点,对我国残疾人社会融合意义深远。要用《民法典》的全部规则来推进残疾人的全面融合,用全体社会成员一体化的思维和残疾人社会融入的特殊理念来解读《民法典》。
The Civil Code regulates all aspects of people’s lives,which coincides with the all-round needs of the social integration of the disabled.The entire content of the Civil Code is a record of the full integration of persons with disabilities into society.Regarding the protection of the rights and interests of the mentally disabled,the Civil Code continues the legislation and practice of adult guardianship in China,and improves the special protection for the mentally disabled.Regarding the marriage rights of persons with disabilities,the Civil Code abolishes the prohibition of marriage and provides comprehensive protection for persons with disabilities’ rightto marriage.Regarding the property rights of disabled children,the Civil Code insists that children with disabilities enjoy legal inheritance rights.In order for the disabled to better integrate into society,the Civil Code stipulates the prohibition clause of no refusal,which provides a solid legal guarantee for the disabled to travel.For disability compensation and assistive devices,the Damage Compensation Chapter of the Civil Code has made special provisions.These highlights in the legislation of the Civil Code are of far-reaching significance to the social integration of the disabled in our country.We must use all the rules of the Civil Code to promote the comprehensive integration of persons with disabilities,and use the thinking of the integration of all members of the society and the special concept of social integration of the disabled to interpret the Civil Code.
