摘要
“老龄化社会”的全面来临意味着老龄人正在成为法治建设中不可缺失的重要参与性力量。但从根本上看,老龄人一直作为被国家和社会所保护的对象和客体的存在,这并非对老龄法治主体性的正确解读。传统老龄法治主体性学说存在认知误区,有必要从回应型法、多元治理、主体间性等三方面作出理论回应,以期重构中国老龄法治的主体性学说。对老龄法治主体性理论的证立要坚持真理符合论的验证方法,须从老龄法治发展主体性中进行历史性证立。事实证明,中国老龄人从来都不是单纯的治理客体和对象,而同时是主体性的存在。走一条符合中国现实国情的老龄法治主体性道路,是当下我国老龄法治建设的实践面向和具体要求。
The comprehensive advent of“aging society”means that the elderly are becoming an indispensable participatory force in the construction of the rule of law.But fundamentally,the elderly have always existed as objects and counterparts protected by the state and society,which is not an appropriate interpretation of the subjectivity of the rule of law for the elderly.There are cognitive misunderstandings in the traditional subjective theory of the rule of law for the aged.It is necessary to make responses from the three theoretical perspectives of responsive law,pluralistic governance and intersubjectivity so as to reconstruct the subjective theory of the rule of law for the aged in China.The verification of the subjective theory of the rule of law in the aged should adhere to the verification method of the truth coincidence theory and carry out a factual review from the subjective development history of the rule of law in the aged.Facts prove that elderly people are never purely the objects and counterparts of governance,but are subjective existence at the same time.It is the practical orientation and specific requirement of China’s legal construction for the aged to take a road of legal subjectivity in accordance with China’s reality.
