自动化行政处罚的法律风险及其规制路径

摘要 人工智能技术引领着新一轮科技革命的发展动向,如今人工智能与行政事务正在不断耦合,此举为国家治理和经济社会发展注入了新动能,但也对传统行政管理与执法手段提出了新挑战。作为负担性具体行政行为,人工智能为行政处罚“植入”了自动化芯片的同时,也带来了行政处罚效率价值、精准程度、执法能力提高等优势,但隐藏其背后的处罚频次失序、正当程序失灵、裁量空间缩减、主体责任模糊等法律风险也逐渐凸显出来,正禁锢着自动化行政处罚的效能发挥。因此需要从建立自动化行政处罚动态调整机制、构建自动化行政处罚的程序规制、合理分配人工决策与机器决策之间的权限、明晰自动化行政处罚的责任归属等方面进行合理规制,从而更好地发挥人工智能的“头雁效应”,为行政处罚赋能。 Artificial intelligence technology is leading the trend of a new round of scientific and technological revolution.Nowadays,artificial intelligence and administrative affairs are constantly coupled,which has injected new momentum into national governance and economic and social development,but also posed new challenges to traditional administrative management and law enforcement means.As burden specific administrative act,artificial intelligence has“implanted”an automated chip into administrative penalty,meanwhile,it has also brought advantages such as the efficiency value,accuracy and law enforcement ability of administrative penalty.However,the hidden legal risks such as the disorder of penalty frequency,the failure of due process,the reduction of discretion space and the ambiguity of subject responsibility are gradually highlighted,which restrict the effectiveness of automatic administrative penalty.Therefore,it is necessary to establish a dynamic adjustment mechanism of administrative penalty,construct the procedural regulation,reasonably allocate the authority between manual decision-making and machine decision-making,and clarify the responsibility attribution of automatic penalty,so as to give better play to the“head goose”effect of artificial intelligence and empower administrative penalty.
