摘要
凝聚共同价值理念是中国共产党治国理政的显著优势。目前,司法激励研究以物质分析为主,对精神层面的解释不足,难以揭示当代中国司法活动背后的制度伦理。法院党组作为党领导司法的重要组织形式,承担着价值引领职能。它通过嵌入法院领导机构,获得了开展价值引领的组织权威、组织网络和组织信息。法院党组的价值引领能够弥补物质激励的局限,其主要依据由党的领导、服务大局和群众路线构成的价值体系,经由一系列动作、言语和物质传播符号对司法组织实施精神激励。这有利于推动党凝聚共同价值理念的制度优势在司法场域转化为政治定向、组织聚力、社会回应和系统协同效能。统筹好"两个大局",亟待进一步提升法院党组的价值引领力,凝聚公正高效权威司法的强大力量。
The cohesion of common values is a significant advantage of the Communist Party of China in governing the country. At present, the research on judicial incentives is mainly based on material analysis, and the interpretation at the spiritual level is insufficient, thus it is difficult to reveal the institutional ethics behind judicial activities in contemporary China. As an important organizational form of judicial leadership by the party, Party groups of courts undertake the function of value guidance. By being incorporated in the court leadership organs, they obtain the organizational authority, organizational network and organizational information to carry out values guidance. The values guidance by Party groups of courts can make up for the limitations of material incentives by imposing spiritual incentives on judicial organizations through a series of actions, words and material communication symbols mainly on basis of the values system composed of the Party’s leadership, serving the overall situation and the mass line. This is Conducive to Promoting the institutional advantage of the party’s cohesion of common values being turned into the efficacy of political orientation, organizational cohesion, social response and system synergy in the judicial field. To coordinate the "two overall situations", it is urgent to improve the capability of valuesguidance of Party groups of courts and achieve powerful strength of fair, efficient and authoritative justice.
