摘要
聚焦于科学事实与制度规范层面的耕地保护命题,因相关规范设定的零散性与对策性,往往使其释义学研究立场趋于碎片化与工具化。有必要立足于耕地保护行为的规范标准,以及相应的机构建制与治理事项,来确定耕地保护条款的相关核心范畴。基于此,梳理改革开放以来该类条款所蕴含的价值目标及演进理路,识别不同时期耕地保护条款的动机取向、厘清所涉耕地保护措施手段的存续特点、评判相应规范体系的主旨要义,从而为我国耕地保护规范的体系性完善提供必要的理念指引。事实上,改革开放以来耕地保护的主导样态存在较为明显的阶段性演进,"严控数量—数量与质量并举—生态发展"的三阶要义,为相应条款蕴含的价值目标变迁提供了必要的现实支撑。"规模化—效益化—优质化"的价值目标变迁,不是承继替代关系,而是共生整合关系,旨在引领确立我国耕地保护的整全性立场与多维化举措。
The proposition of cultivated land protection focused on the scientific fact and system specification levels often make its rechtsdogmatik research standpoint tends to be fragmented and instrumental because of the discreteness and countermeasure of related specification setting.It is necessary to set the related core category of cultivated land protection clauses based on the normative standard of cultivated land protection behavior and the corresponding agency framework and governance matters.Based on it,we should comb through the value target and evolution path contained in this kind of clauses since the reform and opening up,and try to identify the motivation orientation of cultivated land protection clauses in different periods,clarify the survival characteristics of cultivated land protection measures means involved,evaluate the theme essence of the corresponding normative system,so as to provide the necessary idea guidance for the systematic improvement of cultivated land protection specification setting in China.Practically,the dominant modality of cultivated land protection has relatively obvious phased evolution since the reform and opening up.The third-order essence of strictly controlling quantity-quantity and quality simultaneously-ecological development"provides the necessary practical support for the evolution of value target contained in the corresponding clauses.The evolution of value target of"scale-efficiencyoptimization"is not an inheritance and substitution relationship,but a symbiosis and integration relationship.It aims to lead the establishment of the integrity standpoint and multidimension measure for cultivated land protection in China.
