司法区块链视域下电子数据的线上化证明 被引量:9

摘要 随着数字技术对物理空间信息存储方式的变革,电子数据的技术性需求与司法实践的转化式适用产生了不可调和的矛盾。司法区块链的制度化建构为电子数据的线上化证明提供了“区块链+司法”的全新发展方向。在存证阶段,司法区块链通过数据稳定存储,建立数据可信载体与全程可追溯机制。在取证、举证阶段,司法区块链可以通过借助参与共识,辅助电子数据真实性认定,并对接公证机关出证。在质证、认证阶段,司法区块链能够有效减少电子数据生成机制、存储过程中的不稳定因素,提升司法效率。司法区块链平台下的电子数据证明以法律规则与技术共识耦合的方式开启了电子数据全流程线上化证明的司法证明新高度,形成独具特色的中国特色社会主义司法制度。 With the transformation of digital technology on the physical space information storage mode,the technical requirements of electronic data and the transformational application of judicial practice have produced irreconcilable contradictions.The institutionalized construction of judicial blockchain provides a new development direction of“blockchain+justice”for the online proof of electronic data.In the evidengce stage,the judicial blockchain establishes a reliable data carrier and a full traceability mechanism through the stable storage of data.In the stage of obtaining evidence and producing evidence,the judicial blockchain can assist in the verification of the authenticity of electronic data by participating in consensus,and connect with the notary agency to issue certificates.In the stage of cross-examination and certification,judicial blockchain can effectively reduce the unstable factors in the electronic data generation mechanism and storage process to improve judicial efficiency.The electronic data certification under the judicial blockchain platform has opens a new height of online judicial certification in the whole process of electronic data by coupling legal rules and technical consensus,which forms a unique socialist judicial system with Chinese characteristics.
