摘要
中国流域水资源生态保护及修复不仅关系到沿岸区域的生态安全,而且与区域经济的持续性发展、资源的合理高效利用密切相关。通过对中国流域水资源生态补偿的立法现状加以了解,明确流域水资源的生态补偿在法律体系层面、资金来源层面、补偿方式层面以及行政监管层面存在的问题,不仅影响生态补偿机制的顺利实施,还会对流域水资源生态环境保护产生影响。为构建系统且科学的流域水资源生态补偿法律机制,应分别从完善流域水资源生态补偿的法律法规、拓宽流域水资源生态补偿的资金来源、创设多元化的流域水资源生态补偿方式以及完善水资源生态补偿的行政管理体制着手。
The ecological protection and restoration of water resources in China’s river basins is not only related to the ecological security of the coastal areas,but also closely related to the sustainable development of the regional economy and the rational and efficient use of resources.By understanding the current status of the legislation on ecological compensation for water resources in river basins in China,it is clear that the ecological compensation for water resources in river basins has problems at the legal system level,fund source level,compensation method level,and administrative supervision level,which not only affect the smooth implementation of the ecological compensation mechanism,but also It will also have an impact on the ecological and environmental protection of water resources in the river basin.In order to build a systematic and scientific legal mechanism for ecological compensation of water resources in river basins,the laws and regulations on ecological compensation of water resources in river basins should be improved,the sources of funds for ecological compensation of water resources in river basins should be broadened,and diversified methods of ecological compensation of water resources in river basins should be established.The administrative management system of resource ecological compensation is started.
