摘要
社会主义核心价值观融入网络空间治理,有利于凝聚网络空间的价值共识,统筹协调网络安全与信息化发展之间的价值冲突,为网络空间治理体系和治理能力现代化提供价值指引。法治是网络空间安全与信息化发展的重要价值基石,推动社会主义核心价值观融入网络空间治理现代化,必须遵循良法善治的法治逻辑。这其中,良法之治是治理体系现代化的法治依托,传统法律体系无法回应网络空间治理体系现代化需求,需要融入良法所蕴含的各种核心价值要素,并在技术发展与制度治理的双向互动中重构网络空间治理法律秩序。而追求善治则是治理能力现代化的法治动能,善治导向的法治理念要求网络空间治理从"管控型"向"治理型"转变,不仅要充分发挥多元主体的国内网络空间共治优势,而且要推动形成开放合作的国际网络空间治理格局。
The integration of socialist core values into cyberspace governance is conducive to reaching the value consensus of cyberspace, coordinating the value conflict between cyber-security and informatization development, and providing value guidance for the modernization of cyberspace governance system and governance capabilities. The rule of law is an important value cornerstone for the development of cyberspace security and informatization. To promote the integration of socialist core values into the modernization of cyberspace governance, we must follow the rule of law logic featuring good law and good governance. Among them, the rule of good law is the legal basis for the modernization of the governance system. The traditional legal system cannot respond to the needs of the modernization of the cyberspace governance system. It requires the integration of various core value elements contained in good law, and the reconstruction of legal order of cyberspace governance in two-way interaction between technological development and institutional governance. The pursuit of good governance is the driving force for the rule of law in the modernization of governance capabilities. The concept of the rule of law oriented to good governance requires the transformation of cyberspace governance from a “control type” to a “governance type”, which means not only to give full play to the advantages of domestic cyberspace co-governance by multiple actors, but also to promote the formation of an open and cooperative international cyberspace governance pattern.
