摘要
2018年修订的《中华人民共和国刑事诉讼法》创设了衔接留置型刑事拘留制度,自此出现了三种不同的刑事拘留类型,即侦查保障型刑事拘留、转羁押型刑事拘留、衔接留置型刑事拘留。衔接留置型刑事拘留仅适用于审查起诉阶段,可以在监察留置案件移送审查起诉时及时剥夺犯罪嫌疑人的人身自由,以满足办案的需求,同时也有助于实现司法制约。为了充分保障犯罪嫌疑人的权利,需要办案机关之间密切配合,确保在将犯罪嫌疑人拘留后24小时内将其送至看守所羁押;决定拘留后24小时之内对其进行附随讯问,该讯问应当在看守所内进行;保障“执行拘留”当日的律师介入权,并将拘留地点和原因告知犯罪嫌疑人家属。在实践中,应当通过提前介入制度来完善监察留置与强制措施的衔接。
The Criminal Procedure Law was amended to create the criminal detention system of connecting supervisory-retaining in 2018,then there are three different types of criminal detention:criminal detention of investigation guarantee,transitional criminal detention and connecting supervisory-retaining criminal detention.The criminal detention of connecting supervisory-retaining is only applicable to the stage of review and prosecution.When supervisory-retaining cases transferred to review and prosecution,depriving the personal freedom of suspects timely,not only meets the needs of handling cases,also helps to restrict the judicial process.In order to protect the rights of the suspects fully,which needs the closely cooperation with the authorities,to ensure that the detention is not reaching for more than 24 hours before taking into detention center,and the attached interrogation should be conducted 24 hours after detention.The interrogation should be in the detention center,and should guarantee the lawyer's right to get involved on the day of taking into detention center,and inform the suspect's family members of the place of detention and the reason.In practice,the system of early intervention should be used to improve the connection between supervision and investigation and compulsory measures.
