摘要
我国刑事立案制度的发展以刑事诉讼法、法律解释和政策性文件的颁布和修订为结点大致可以分为四个阶段,即初创与确立阶段(1949—1979)、适应与发展阶段(1980—1996)、反思与完善阶段(1997—2013)和变革与创新阶段(2014至今)。其实现了刑事案件的有序分流和诉讼效率的有效提高,在保障人权、控制权力、评估治安和预防犯罪等方面发挥着重要作用。当下发展,我国刑事立案制度在法律解释、立案标准、立案程序、刑事初查和立案监督等方面,还存在着一些问题和挑战。未来创新,在宏观层面,应当以实践为基准,以理论为导向,遵循法治规律,推进刑事立案体制改革;在中观层面,应当解决刑事立案制度突出问题,提升制度运行实效。在微观层面,应当完善刑事立案规范,推进制度设计的精细化。
The development of China’s criminal case filing system is based on the promulgation and revision of the criminal procedure law,legal interpretation and policy documents,which can be roughly divided into four stages,namely,the start-up and establishment stage(1949-1979),the adaptation and development stage(1980-1996),the reflection and improvement stage(1997-2013)and the reform and innovation stage(2014 to now).It realizes the orderly diversion of criminal cases and the effective improvement of litigation efficiency.It plays an important role in protecting human rights,controlling power,evaluating public security and preventing crime.At present,there are still some problems and challenges in the legal interpretation,filing standards,filing procedures,preliminary criminal investigation and filing supervision of China’s criminal case filing system.For future innovation,at the macro level,we should take practice as the benchmark,theory as the guidance,follow the law of the rule of law,and promote the reform of the criminal case filing system;At the meso level,we should solve the prominent problems of the criminal case filing system and improve the effectiveness of the system.At the micro level,we should improve the norms of criminal case filing and promote the refinement of system design.
