摘要
依法治藏是实现以习近平同志为核心的党中央依法治国与“治边稳藏”战略布局的必由路径。依法治医作为依法治藏的重要维度,对于深入推进“健康中国”“健康西藏”建设具有重大意义。在我国医事法治建设进程不断加速之现实情境下,西藏作为边疆民族地区,尤应把准其中的政治站位、关键环节、现实问题。当前西藏医事法学理论研究相当薄弱,探寻新时代西藏医事法治基本路径乃至为全国民族地区医事法治提供“西藏范式”,是法治西藏建设中极具学术价值和实践意义的探索。
The governance of Tibet must always be done according to the law,is an indispensable pathway to realize the strategy on ‘Law-based Governance’ and ‘Governing Border Areas and Ensuring Stability in Tibet’proposed by Chinese Communist Party Central Committee with the general secretary Xi Jinping as the core. As a crucial part of ‘Governing Tibet by Law’ strategy,Tibet’s medical affairs should be undertaken within the law,and it is of great significance to promote the construction of‘Healthy China’ and ‘Healthy Tibet’ initiatives. With the accelerating process of the legal construction in medical affairs,a frontier ethnic region like Tibet should focus on its political position,key elements and practical problems in implementing the governing the Tibet’s medical affairs according to the law policy. At present,the theoretical research on medical law in Tibet is quite weak. Exploring the basic path of medical law in Tibet in the new era and providing ‘Tibetan paradigm’ for medical law in ethnic areas across the country is an exploration of great academic value and practical significance in the construction of the rule of law in Tibet.
