摘要
自"太阳风"供应链攻击事件发生以来,国际上掀起了关于加强供应链安全国际法保护的讨论热潮。以现有国际法适用于网络空间这一国际共识为出发点,在适用性方面争议不大的主权、不干涉内政与禁止使用武力原则可以在保护供应链安全上发挥一定作用。但受制于不同情境与解释路径的复杂性,其实际保护效果不容夸大。究其原因,现有国际法所具有的内在缺陷不仅助长了学理纷争,还制约了各国实践。为弥补国际法的适用短板,国际上对网络空间特别法的制定需求日益强烈,负责任国家行为规范正因之迅速崛起。中国应积极参与这一专门性规范的建构进程,在深入认识规范意义的基础上,从内容把控、出路锚定、灵活推广、拓展参与四个方面积极引领制定符合中国利益的供应链安全新规则。
The “SolarWinds” supply chain attack has triggered a heated debate on how to enhance the international law protection for supply chain security. Bearing in mind that existing international law is applicable to cyberspace, those rules whose applicability has been generally recognized can protect supply chain security to a certain degree, such as the principles of sovereignty, non-intervention, and the prohibition of the use of force. But subject to the different situations and complex methods of interpretation, the actual effectiveness of protection is insufficient. The reason is that international law is not a silver bullet, and its inherent defects not only give rise to academic controversies, but also hamper state practices. Due to the failed promise of existing international law, there is an increasing demand for the remedy of the new rules specifically designed for cyberspace, and as a result, the norms of responsible state behavior have quickly emerged and developed. China should actively engage in the norm construction process, gain a deep understanding of the significance of norms, and take the lead in the rule-making for supply chain security by further balancing the content of the norms, clarifying the avenues for norm development, promoting norms in flexible ways, and expanding participation in norm evolution.
