摘要
平等原则作为行政行为实质合法性的审查标准之一,在适用范围不断扩大的过程中,却出现了突破法源适用位阶、与法的拘束产生冲突以及与比例原则发生混淆的问题,导致有些行政审判在应当适用平等原则的时候没有适用,或在不应适用平等原则的时候却予以适用。为此,应从三方面开展应对。首先,必须坚守平等原则的补充性地位,明确适用平等原则的案件类型;其次,要设定平等原则的适用限度,保护当事人的合法权益;最后,应厘清平等原则的功能定位,区分平等原则与比例原则的适用。
The principle of equality is one of the criteria for the substantive legality review of administrative act,however,in the process of expanding the scope of application,there are some problems,such as breaking through the application rank of the source of law,conflicting with the restriction of law,and being confused with the principle of proportionality,which cause that the principle of equality has not been applied in some cases of administrative adjudication when it should have been,or has been applied in some other cases when it should not have been.The countermeasures against these problems should be taken from three aspects:first,the complementary status of the principle of equality must be adhered to and which type of the cases is applicable to the principle of equality must be clearly defined;second,the application limit of the principle of equality should be set to protect the legitimate rights and interests of the parties concerned;third,the functional orientation of the principle of equality should be clarified and the application of the principle of equality and that of proportionality should be distinguished.
