摘要
随着“一带一路”倡议的逐步落实,中国—东盟之间与贸易有关的知识产权纠纷更多地发生在缔约方国民之间。现有各层面的争端解决机制存在适用困局,大量的私主体之间的知识产权争议无法得到妥善处理。新近签署的RCEP协定项下知识产权新政策与国际商事仲裁框架则为这一争议的私人解决提供了新的可能。未来应当以机构仲裁为主,整合国内现有仲裁机构资源,着力提升知识产权仲裁能力;推动我国与东盟国家仲裁机构之间开展联合仲裁,逐步探索建立中国—东盟知识产权国际仲裁中心。
With the gradual implementation of the“Belt and Road”Initiative,more and more trade-related intellectual property disputes occur among the nationals of the contracting parties of China and ASEAN countries.However,the existing dispute settlement mechanisms at all levels have difficulties in application,and a large number of intellectual property disputes between private entities cannot be properly handled.The new intellectual property policy under the recently concluded RCEP and the international commercial arbitration framework provide new possibilities for private settlement of such disputes.In the future,it is privileged to focus on institutional arbitration,and to integrate the resources of existing domestic arbitration institutions,to improve the ability of intellectual property arbitration,and to gradually explore the establishment of a China-ASEAN Intellectual Property Rights International Arbitration Center.
