摘要
我国水资源与水生态环境的司法保护逐渐呈现救济手段多样、保护范围拓宽、保护目标明晰的特点。然而,水资源与水生态环境仍面临各类保护主体协作困难、对地下水保护力度不足、责任追究制度运行不畅等问题。究其原因,主要在于水资源与水生态环境司法保护的保护主体制度不健全、责任认定标准不明确、责任追究制度不系统。因此,应当进一步明确行政机关、人民检察院和社会环保公益组织的主体地位作用,优化多主体之间的协作机制;统一责任认定标准,正确理解《矿产资源法》《水法》之间的关系;优化水资源与水生态环境司法保护的责任追究程序,注重生态环境损害赔偿诉讼与环境公益诉讼的衔接,明确责任追究方式,协调适用刑事、民事、行政责任方式,形成政府主导、公众参与、司法保障的水资源与水生态环境司法保护新格局。
The judicial protection of water resources and water ecological environment in China gradually presents the characteristics of diverse means of relief,broadening the scope of protection and clear protection objectives.However,water resources and water ecological environment is still facing various types of protection subject collaboration difficulties,the protection of groundwater is not enough,the accountability system does not work well.The reason for this,mainly in water resources and water ecology and environmental judicial protection of the protection of the main body system is not sound,the responsibility for determining the standard is not clear,the accountability system is not systematic.Therefore,we should further clarify the role of administrative organs,people's procuratorates and social environmental protection public welfare organizations,optimize the collaboration mechanism between multiple subjects;unify the standards of liability determination,and correctly understand the relationship between the Mineral Resources Law and the Water Law;optimize the accountability procedures for judicial protection of water resources and water ecology and environment,focus on the interface between ecological and environmental damage compensation litigation and environmental public interest litigation,and clarify the responsibility pursuit of ways to coordinate the application of criminal,civil and administrative liability,the formation of government-led,public participation,judicial protection of water resources and water ecological environment judicial protection of the new pattern.
