摘要
国内规制主权与自由贸易间关系长期为人关注,对此部分经济体就曾利用"良好监管实践"优化内部规制并形成经验。在近年各类经贸谈判中,原本主要适用于国内的"良好监管实践"正成为重要协定下的新议题,其中CPTPP"监管一致性"、USMCA"良好监管实践"等已成为国际监管合作的重要制度型规范,并呈现国内和国际双层治理相互促进之特征。上述进展体现了国际经贸治理演进新趋势,与RCEP所遵循的传统WTO相关纪律差异较大。随着进入"制度型开放"的新阶段,中国也应关注参与"良好监管实践"的国际合作,支持促进协调引导型治理范式;针对贸易投资等开展国内监管改革,率先衔接"良好监管实践"国际规范。
The relationship between domestic regulatory autonomy and international trade liberalization has been concerned for a long time.Thus,some economies have used good regulatory practices(GRP)to optimize domestic regulation for international trade and form the experience.In recent years,the GRP which is mainly originated from the domestic systems has become a new issue in the international trade negotiation,including“Regulatory Coherence”in CPTPP and“Good Regulatory Practices”in USMCA,which has become the institutional components of the international regulatory cooperation(IRC),and has the characteristics of the mutual convergence between the domestic and international governance.This progress reflects the new trends of the international trade governance,and shows difference with the relevant rules of RCEP,which followed the traditional formula from WTO.After entering the institutional opening-up,China should pay more attention to participate in the international cooperation of GRP,and favor the paradigm with the directing and coordinating characters.In addition,China should promote the domestic regulatory reform of the international trade and investment,and lead the charge to connect the international rules of GPR.
