摘要
区块链以其"去中心化"开放式的技术给金融领域带来重大变革。如何创新监管模式以应对区块链金融潜在的风险,成为学术界和实务界共同关注的重要议题。沙箱监管作为金融监管的模式创新,为防范金融科技风险、推动金融创新提供了更为适宜的制度空间。同时,为金融法治发展赋予了充分的理论与实践依据。在我国大力发展金融科技的背景下,借鉴沙箱监管的理论与实践,从软法治链理念、监管形式、监管科技三个维度进行本土化设计,在严格控制风险的前提下进行监管模式转型,以实现区块链金融创新与监管的双赢局面。
Blockchain has made major changes to the financial field because of its open technology called "decentralized".How to innovate the regulatory model to deal with the potential risks of blockchain finance has become an important topic of common concern in academic field and practice field.Sandbox supervision, as a model innovation of financial supervision, provides more appropriate institutional space for preventing financial technology risks and promoting financial innovation.At the same time, sandbox supervision has given sufficient theoretical and practical basis for the development of financial rule of law.Under the background of our country’s vigorous development of financial technology, we can take example by the theory and practice of "Regulatory Sandbox", and carry out localization design from the three aspects:soft law chain concept, supervision form and supervision technology, and supervise under the premise of strict risk control. The transformation of the model to achieve a "win-win " situation of blockchain financial innovation and supervision.
