摘要
象征性刑事立法是一种被广泛运用的批判性标签。不过,就象征性刑事立法的存在范围,我国学界存在明显的分歧。由此引发了对这一立法批评模式的反批评,甚至有观点转而承认象征性刑事立法的正当性。从象征性刑事立法的起源与流变中,可分别获取其积极面与消极面,即作为价值建构的“象征”以及法益保护机能的缺失。象征性刑事立法应被界定为完全没有法益保护机能仅以价值认同为存在根据的罪刑规范。目前的学说要么过于侧重其表象,要么过于狭隘地理解了法益保护机能的实现方式,导致象征性刑事立法批判的误用。肯定象征性刑事立法的观点,低估了其负面效果,高估了其对民众情绪的意义。欠缺适格的法益、法益侵害归因错误和违背刑法保护法益的作用机理,都可能导致象征性刑事立法。对象征性刑事立法,可通过立法进行纠正,也可以通过司法限缩等方式予以补救。
Symbolic criminal legislation is a critical label that is widely used.However,there are sharp differences between scholars as to the scope of symbolic criminal legislation in Criminal Code of China,which leads to counter criticisms against this model of legislative criticism.There are even views that have turned to recognise the legitimacy of symbolic criminal legislation.From its origin and development can we derive the positive and negative aspect of symbolic criminal legislation,which is the‘symbol’as a kind of value construction and the lack of function of legal interest protection,respectively.Symbolic criminal legislation should be defined as a criminal norm that has no function of legal interest protection and is based merely on value identification.The current research either focuses too much on its representation,or narrowly understands the mechanisms of the legal interest protection,which leads to the misuse of legislative criticism.The viewpoint that supports symbolic criminal legislation underestimates its negative effects and overestimates its significance to the public’s emotion.Lack of qualified legal interest,wrongful ascription of legal interest infringement and violation of the mechanism of criminal law to protect legal interests may all lead to symbolic criminal legislation.Symbolic criminal legislation can be corrected through legislation,and it can also be remedied through judicial restriction and judicial abeyance.
