摘要
公共危机中信息披露的主要主体包括政府和公众。政府信息披露是公民安全保障权和知情权的必然要求,是危机沟通的需要,也可以解决政府与公众之间信息不对称的问题;公民披露信息则是公民基本权利之一,可以补强政府获取信息的能力,也可以促进公共危机时期法律的执行。对于公共危机时的信息披露,国外有不少立法和实践经验可供我们借鉴。就政府信息披露来说,应完善立法并加强法律及政府部门之间的协调,完善追责机制并拓宽披露的渠道。就公民信息披露来说,应重构我国的举报制度,加强对潜在信息披露人的激励和保护,并确立紧急情形下的信息披露机制。
The main subjects of information disclosure in public crisis include the government and the public.Government information disclosure,the inevitable requirement of citizens’right to guarantee safety and the right to know,is the need for crisis communication,and can also solve the problem of information asymmetry between the government and the public.Citizen information disclosure is one of the basic rights of citizens,which can strengthen the government’s ability to obtain information,and can also promote the implementation of laws in times of public crisis.For the information disclosure in public crisis,there are many excellent legislation and practical experience abroad.For the government information disclosure,we should improve the legislation and strengthen the coordination between the law and government departments,and improve the accountability mechanism and broaden the channels of disclosure.As far as citizen information disclosure is concerned,we should reconstruct the whistleblowing system of our country,strengthen the incentive and protection to potential whistleblower,and establish the whistleblowing mechanism in emergency situations.
