摘要
我国在构建个人破产程序的过程中存在各种争议,但在争议中也对诸多问题达成了共识。个人破产程序相关理论内在的争议度与共识度究竟有多少值得探究,这关乎我国个人破产程序能否得以科学地构建。通过对571位受访者进行问卷调查可知,受访者整体在个人破产制度建立的必要性、个人破产程序的程序功能、立法目的以及破产和解程序适用等问题上基本达成了共识,但对于个人破产程序建立后可能引发的社会风险、程序模式的选择、适用主体的范围以及破产清算程序的设计等问题仍有较大争议。通过使用在线SPSS软件对不同职业组别的受访者的选择进行检验后发现,不同职业组别的受访者对债务人不能清偿到期债务的态度、个人破产程序建立的必要性、破产清算程序与破产和解程序的设计与应用等问题的选择与受访者整体的选择存在显著性差异。为此,我国在构建个人破产程序的过程中,应争取更广泛的理论共识,并尽量缩小理论分歧。
There are many controversies in the construction of personal bankruptcy procedure,but there are also many theoretical consensus on many issues.The degree of controversy and consensus behind the theory of personal bankruptcy procedure is worth exploring,because it is related to whether the personal bankruptcy procedure can be constructed scientifically.Through a survey of 571 interviewees involved in the field of law and bankruptcy,we can see that the interviewees have basically reached a theoretical consensus on the necessity of establishing the personal bankruptcy system,the procedural function of the personal bankruptcy procedure,the legislative purpose and the application of the reconciliation procedure,but they are not satisfied with the social risks,the procedural mode selection,the scope of application and the design of liquidation procedure that may arise after the establishment of the personal bankruptcy procedure.Through online SPSS software analysis of the choices of interviewees in diferent occupational groups,we can see that there are significant differences between different groups of interviewees in the attitude of the debtor's inability to pay off due debts,the necessity of establishing personal bankruptcy procedures,the design and application of liquidation procedures and settlement procedures.In the design of specific rules,we should strive for a broad theoretical consensus and narrow the theoretical differences.
