摘要
中国“首例微信小程序案”反映了近年来涌现的新型网络服务提供者在适用“通知—删除”规则时所遇到的问题,小程序平台发挥传递信息和内容的作用,没有影响或控制的能力,如果“一刀切”要求其删除所提供的服务,可能违背比例性的原则。本文对小程序平台进行类型辨析,分析其是否可以驶入“避风港”免责,并基于“通知—删除”规则适用存在的局限性,提出增加“转通知—反通知—恢复”义务,增加网络服务提供者事前必要的审查义务,完善网络著作权集体管理组织的建议。在鼓励互联网技术创新时,应加强平台的综合治理,同时亦保护版权人的合法权益。
China’s“first WeChat Mini Program case”reflects the problems encountered by new network service providers that have emerged in recent years when applying the“notice-delete”rule.The mini programs serve to convey information and content,without the effect or ability to control,if the“one size fits all”rule requires them to delete the services provided,it may violate the principle of proportionality.This article analyzes the types of small programs,analyzes whether they can enter the“safe harbor”exemption,and start from the limitations of the application of the“notification-delete”rule,proposes to add the obligation of“redirect notification-counter-notification-recovery”and add necessary review obligations for network services providers to perform beforehand,and improve the collective management organization of network copyrights.When encouraging Internet technology innovation,the comprehensive governance of the platform should be strengthened while protecting the legitimate rights and interests of copyright owners.
