摘要
作为一个农业大国,加强对植物新品种的知识产权保护对促进中国农业经济发展,稳定中国种业市场,实现现代农业发展战略目标具有重要的作用。因此,本研究在分析了中国现代农业发展战略下植物新品种知识产权保护发展现状的基础上,指出中国植物新品种知识产权保护现存问题主要包括植物品种原始创新力较匮乏、产权保护范围较局限、产权保护意识较薄弱。并基于现存问题提出合理的植物新品种保护的法律完善建议,以期为中国政府更好地落实植物新品种知识产权保护工作开展提供参考。
As a large agricultural country,strengthening the intellectual property protection of new plant varieties plays an important role in promoting China’s agricultural economic development,stabilizing China’s seed industry market and realizing the strategic goal of modern agricultural development.Therefore,based on the analysis of the development status of intellectual property protection of new plant varieties under China’s modern agricultural development strategy,this study points out that the existing problems of intellectual property protection of new plant varieties in China mainly include the lack of original innovation of plant varieties,the limited scope of property protection and the weak awareness of property protection.Based on the existing problems,this paper puts forward reasonable legal improvement suggestions for the protection of new plant varieties,in order to provide reference for the Chinese government to better implement the suggestions on the protection of intellectual property rights of new plant varieties.
