摘要
从甘肃省C县农业行政执法机关依法查处一起农民个人销售假油菜种子“春华501油菜”案例出发,探讨了《中华人民共和国种子法》(以下简称《种子法》)对农民特权的法律规定,从不同法律要素解析了“农民销售、串换自繁自用剩余常规种子”行为合法与违法的界线,为今后各级农业行政执法机关依法管理类似种子案件提供参考和借鉴。
Based on a case of selling fake rapeseed seeds Chunhua 501 by a farmer from C county of Gansu province,the legal provisions of farmers’privilege under the Seed Law of the People’s Republic of China(hereinafter referred to as the Seed Law)were discussed.The legal and illegal boundaries of“farmers’sale and exchange of surplus conventional seeds for self-propagation and self-use”from different legal elements were analyzed,which provided reference for agricultural administrative law enforcement organs at all levels to manage similar seed cases in the future.
