摘要
澳大利亚既是世界上生物多样性最为丰富的国家之一,也是被公认为全球动植物检疫监管最严格的国家之一。2015年以来,随着澳大利亚检疫机构和相关法律的不断变更,现今已形成《生物安全法》为统领的生物安全法律体系。新冠疫情的暴发将社会各界普遍关注的生物安全问题再次推向高潮,我国于2020年10月17日通过了首部《中华人民共和国生物安全法》,体现了新时代对于生物安全的重视。本文通过阐述《澳大利亚生物安全法》的相关内容,分析澳大利亚生物安全法律体系的现状和特点,为关检融合背景下我国海关全面深化改革和国门生物安全防护提供建议。
Australia is not only one of the most biodiversity-rich countries in the world, but also is recognized as one of the most stringent animal and plant quarantine measures in the world. Since 2015, with the continuous changes of Australian quarantine authorities and related laws, the Biosecurity Act has now become the leading Biosecurity legal system. The outbreak of the COVID-19 has pushed the issue of biosecurity, which is concerned by all circles of society, to a climax again. On October 17,2020, China passed the first Biosecurity Law of the People’s Republic of China, the importance of biosecurity in the new era. By expounding the relevant contents of the Australian Biosecurity Act, the paper analyzes the present situation and characteristics of the biosecurity legal system in Australia and provides suggestions for deepening the reform of China’s customs and biosecurity protection under the background of integration of Customs and Quarantine.
