摘要
随着移动互联网、云计算等技术的不断发展,各种新兴业态不断涌现,其在扩大就业、推动经济社会发展、维护社会稳定等方面发挥了重要作用。但新业态灵活性、高弹性和管理松散化等特点,导致其劳动关系认定较为模糊,给当前法律和社会保险制度带来较大挑战。通过调查发现新业态从业者普遍存在工作时间长、职业风险高、社会保险缺失、权益维护难等问题。政府应改革工伤保险制度、提高办事水平、强化各方协商机制,切实维护新业态从业者的合法权益。企业应在行业自律和社会责任等方面进行改进,保障新业态健康可持续发展。
With the continuous development of mobile Internet,cloud computing and other technologies,a variety of emerging industries have emerged,playing an important role in expanding employment,promoting economic and social development,maintaining social stability and other aspects.However,due to its strong flexibility,high elasticity and loose type management,the labor relation identification is relatively fuzzy,which brings great challenges to the existing laws and social insurance system.From the investigation,new employment form workers are working long hours,taking high professional risk and facing difficulties such as lack of social insurance,hard maintenance of the rights and interests.The government should perfect the law and the social security system,reform the employment injury insurance,improve the service quality,strengthening the consultation mechanism.Enterprises should improve in industry self-discipline healthy and sustainable development of new forms of economy.
