摘要
共享经济的发展催生出“外卖骑手”网约工这一新型用工形式,该用工形式呈现出工作形式灵活程度高、平台对其管理隐蔽性强以及用工关系复杂程度高等新特点。因我国现行劳动关系认定标准的滞后性、模糊性以及二分法保护体系的局限性,网约工与外卖平台的用工关系认定存在很大争议,司法实践中也难以保持认定的统一性,不利于网约工及受其侵害的第三人的利益的保障。应当先行出台指导性案例对该用工关系的确认提供指引,加快修改完善事实劳动关系的认定标准,并尝试在二分法保护体系之外增加第三种用工关系,为网约工权益的保护提供弹性化的选择空间,以实现共享经济平台发展与网约工权益保护的良性互动。
The development of the sharing economy has given birth to a new type of employment,the“take-out rider”,the employment form has the new characteristics of high flexibility of the work form,high concealment of the platform to its management and high complexity of the employment relationship.Because of the lag and ambiguity of the current labor relations identification standard and the limitation of the dichotomy protection system,it is difficult to identify the employment relationship between the online contract workers and the delivery platform.In judicial practice,there have been a lot of“different judgments in the same case”,the benefits of online contract workers and the third party who is infringed by the network contractors are difficult to be protected.Firstly,guiding cases should be issued to provide guidance for the confirmation of the employment relationship.Secondly,the confirmation standard of the factor labor relationship should be revised and improved.Finally,it is necessary to add a third employment relationship besides the dichotomy protection system to provide flexible choice space for the protection of the rights and interests of network contract workers.These measures will help realize the positive interaction between the development of shared economic platform and the protection of the rights and interests of the network contract workers.
