摘要
伴随人工智能的发展,宪法的价值体系面临人权消解、法治系统的权力失衡和民主新可能的问题。如何应对这些挑战将是宪法的时代责任。结合人工智能意识产生前后的能力差异,以及社会影响强弱,宪法的战略回应可归类为短期策略和长期策略。在弱人工智能时代,短期策略是宪法解释,主要任务是加强科技宪法的研究。在强人工智能、超人工智能时代,长期策略是修改宪法、专门人工智能立宪。在回应模式构建中,应将弹性理论与宪法应对联系起来。宪法弹性的构建,是主动应对人工智能挑战的战略,既能为应对人工智能的系统性宪法价值破坏做好积极准备,又能为应对人工智能的破坏性而产生宪法价值新形式提供机会。
With the development of artificial intelligence,the value system of the constitution faces the problems of elimination of human rights,the imbalance of power in the rule of law system,and the new possibility of democracy.How to meet these challenges will be the constitution duty of the day.In this context,the strategic response of the constitution can be classified into short-term strategy and long-term strategy based on the ability difference before and after the emergence of artificial intelligence consciousness and the strength of social influence.In the era of weak artificial intelligence,the short-term strategy is to interpret the constitution,and the main task is to strengthen the research on constitution of science and technology.In the era of strong artificial intelligence and super artificial intelligence,the long-term strategy is to amend the constitution and make a constitution exclusively for artificial intelligence.In the construction of response model,the resilience theory should be linked with constitutional response.The construction of constitutional resilience is a strategy to actively respond to the challenges of artificial intelligence.It not only actively prepares for the systematic destruction of constitutional value of artificial intelligence,but also provides opportunities for new forms of artificial intelligence’s destructive constitutional value.
