摘要
哈萨克斯坦作为中亚地区最大的能源输出国,从长期来看对我国的能源安全保障具有重要的战略性意义。当前,在“一带一路”倡议的大背景下,中哈能源合作稳步发展的同时也在法律保障领域迎来了诸多挑战。这些问题的存在既同我国国内相关立法的缺失有关,也在一定程度上源于对于国际法、国际合作机制、国际条约、国际惯例的运用不擅。“一带一路”背景下中哈能源合作法律保障机制的构建与完善,既需要我国加强自身的能源专项立法,逐步实现跨境能源合作的法治化,也亟需中哈进一步增强两国间的政治互信与深层次司法合作,从而有效解决区域性协议可操作性较弱等问题。
As the largest energy exporter in Central Asia,Kazakhstan has important strategic significance for my country's energy security in the long run.At present,in the context of the Belt and Road Initiative,China-Kazakhstan energy cooperation is developing steadily while also facing many challenges in the field of legal protection.The existence of these problems is not only related to the lack of relevant domestic legislation in my country,but also to a certain extent stems from inadequate use of international law,international cooperation mechanisms,international treaties,and international conventions.The construction and improvement of the legal guarantee mechanism for China-Kazakhstan energy cooperation under the background of the Belt and Road Initiative requires my country to strengthen its own energy special legislation and gradually realize the rule of law for cross-border energy cooperation,and it also urgently needs China and Kazakhstan to further strengthen the politics between the two countries.Mutual trust and in-depth judicial cooperation can effectively solve problems such as the weak operability of regional agreements.
