摘要
拍卖成交裁定被赋予物权变动效力,进而成为《民法典》第229条所称的法律文书,是司法拍卖与任意拍卖长期分离的结果。但《民法典》第229条对动产和不动产的统一适用可能导致拍卖成交裁定的物权变动效力被不当扩张,故应将《民法典》第229条意义上的拍卖成交裁定局限于不动产。就不动产拍卖成交裁定而言,其物权变动效力主要是买受人原始取得财产权利和消灭担保物权,但用益物权与租赁关系可视情形存续。拍卖成交裁定可因法定事由被撤销,但实体事由一般不影响拍卖成交裁定的效力。拍卖成交裁定被撤销的,物权变动效力归于消灭,但是否返还原物应以能够执行回转为限。
The auction transaction ruling is given the effect of property rights change, and then becomes the legal document referred to in Article 229 of the Civil Code, which is the result of the long-term separation of judicial auctions and arbitrary auctions. However, the uniform application of Article 229 of the Civil Code to movable and immovable properties may lead to the improper expansion of the effect of property rights changes in auction rulings. Therefore, auction rulings within the meaning of Article 229 of the Civil Code should be limited to immovable properties. As far as the real estate auction transaction ruling is concerned, the effect of the change in property rights is mainly the buyer’s original acquisition of property rights and the elimination of the security property rights, but the relationship between usufructuary rights and leases may continue depending on the circumstances. The auction transaction ruling can be revoked for legal reasons, but the physical reasons generally do not affect the validity of the auction transaction ruling. If the auction transaction ruling is revoked, the effect of the property right change shall be eliminated, but whether the original property is returned or not shall be limited to the execution of the reversion.
