摘要
当前我国档案安全领域呈现违法高发而刑罚阙如态势,折射出档案行政执法与刑事司法衔接不畅的现实。造成如此困境,既有档案行政立法与刑事立法不协调、案件移送程序不健全、证据转换困难等客观原因,也有档案主管部门选择性执法、检察机关监督乏力等主观因素。推进档案行政执法与刑事司法的顺畅衔接,较为可行的路径是从实体和程序两个方面共同发力。首先,加强档案法与刑法的实体性衔接,明晰档案违法犯罪的判定标准;其次,优化档案违法犯罪案件移送与承接程序,完善档案行政证据转化及认定规则;最后,拓宽档案行政执法与刑事司法衔接中检察监督信息渠道,创新检察监督方式,提升监督刚性。
At present,in the field of archives security,there is a situation of high incidence of violations and lack of punishment,which reflects the reality that the connection between archives administrative law enforcement and criminal justice is not smooth.There are not only objective reasons such as the discordance between the administrative legislation of archives and the criminal legislation,the imperfect procedure of case transfer,the difficulty of evidence conversion,but also subjective factors such as the selective law enforcement by archives department and the weak supervision of the procuratorial organ.To promote the connection between archives administrative law enforcement and criminal justice,the more feasible path is to work together from both the substantive and procedural aspects.First of all,we should strengthen the substantive connection between archives law and criminal law,and clarify the judgment standard of illegal and criminal archives;Secondly,we should optimize the procedure of transferring and accepting illegal and criminal cases,and improve the rules of transformation and identification of administrative evidence;Finally,we should broaden the information channels of procuratorial supervision in the connection of archival administrative law enforcement and criminal justice,enrich the ways of procuratorial supervision,and enhance the quality and efficiency of supervision.
