摘要
从思想史来看,人权先后呈现出天赋以及反天赋论两重面孔,人权概念也呈现出道德概念和政治概念的大体区别。但历史上的两种主张都是建立在虚假的二元对立之上且很难有充足说服力的。只有实践唯物主义视域下的人权概念才是其该当的正解。新的时代,人权的理解和践行也该当进行相应的实践转向。
From the point of view of the history of thought,the concept of human rights presents two faces of the theory of natural rights and Anti-natural rights successively,and the concept of human rights also presents the general difference between the moral concept and the political concept.However,both of them are based on false binary opposition and are difficult to be fully persuasive.Only the concept of human rights under the perspective of practical materialism is the proper solution.In the new era,the understanding and practice of human rights should also be changed accordingly.
