摘要
在我国“以审判为中心”诉讼体制改革的背景之下,法官作为法律专业上的裁判者,很难对各类案件中涉及的专业性知识都做出准确的判断和把握。因此,有必要在诉讼领域中引入专家证人这一角色。在庭审中心化不断推进的今天,专家证人制度已成为我国司法改革的一大亮点。与其他国家相比,我国的专家证人制度尚处于起步阶段,专家证人的诉讼地位不清晰、资质要求不明确、启动程序不完善,对专家证人的管理还没有形成完整的体系。因此,我国应当改进专家证人的准入审查机制,规范专家证人参与诉讼活动的程序,建立专家证人的追责制度。
Under the background of“trial-centered”litigation system reform in China,judges,as referees in the legal profession,are difficult to make accurate judgments and grasps of the professional knowledge involved in various cases.Therefore,it is necessary to introduce the role of expert witness in the field of litigation.Today,with the continuous advancement of the centralization of court trials,the expert witness system has become a highlight of judicial reform in China.Compared with other countries,China’s expert witness system is still in its infancy.The litigation status of expert witness is not clear,the qualification requirements are not clear,the initiation procedure is not perfect,and the management of expert witnesses has not yet formed a complete system.Therefore,China should improve the access review mechanism for expert witnesses,standardize the procedures for expert witnesses to participate in litigation activities and establish an accountability system for expert witnesses.
