摘要
从2013年开始,全国部分地区开始试点行政案件的集中管辖制度。从六年多的试点工作来看,各地做法不一,出现多种集中管辖模式。其中普通法院集中管辖模式最常见。行政案件集中管辖制度虽然是行政案件管辖的重大突破,去除了行政诉讼的主客场弊端,最大限度地保证了行政诉讼的去行政化、去地方化,但是无论采取何种集中管辖模式,都会出现集中管辖法院的审判压力增大、非集中管辖法院行政审判职能的弱化、法院司法成本与当事人诉讼成本的增加的共性问题。在选取集中管辖法院时,要对员额法官办案系数、一审行政案件数、行政审判能力、交通便利程度进行综合考量;在具体措施上,要创新行政审判工作新机制、在人财物上对集中管辖法院适当倾斜。
Since 2013,centralized jurisdiction systems for administrativ e cases have been piloted in some parts of the country.From the more than six years of pilot work,there are different practices and multiple centralized jurisdiction modes have emerged.The most common mode is the centralized jurisdiction of ordinary courts.Although the centralized jurisdiction system of administrative cases is a significant breakthrough in the jurisdiction of administrative cases,which eliminates the drawbacks of home and away in administrative litigation and ensures the de-administration and de-localization of administrative litigation to the maximum extent.No matter what centralized jurisdiction mode is adopted,there will be common problems with increasing trial pressure of the centralized jurisdiction courts,weakening the administrative trial function of the non-centralized jurisdiction courts,and adding to the judicial cost of the courts and the litigation cost of the parties.When choosing a centralized jurisdiction court,comprehensive consideration should be given to the case-handling coefficient of the post judges,the number of first-instance administrative cases,the administrative trial ability,and the traffic convenience.As for the concrete measures,the working mechanism of administrative trial should be innovated,and staff,funds and properties should be appropriately inclined to the centralized jurisdictio n courts.
