摘要
2019年5月,湖南省全面实施行政案件集中管辖改革,兼采基层法院相对集中管辖和铁路法院集中管辖两种模式,开启混合型集中管辖的湖南模式。案件数据等实证资料显示,改革三年来取得了一些成绩,但成效并不显著,面临破除司法地方化效果不明显、原被告诉讼成本分担不平衡、行政机关负责人出庭应诉义务虚置、禁止调解与倡导协调化解相冲突、非集中管辖法院行政审判职能弱化等客观问题,有必要深入审视改革动机与成效、促进便民审判机制常态化、推动出庭应诉法定义务落地、把准协调与干预的尺度、注重行政审判职能协同发展,展望行政案件集中管辖改革的更优前景。
In May 2019,Hunan Province fully implemented the reform of centralized jurisdiction of administrative cases and adopted two modes of relatively centralized jurisdiction of basic level courts and centralized jurisdiction of railway courts,starting the Hunan mode of mixed centralized jurisdiction.Empirical data including administrative cases show that achievements have been made in the past three years of reform,but the effectiveness is not significant.Faced with objective problems such as the insignificant effect of eliminating judicial localization,the unbalanced sharing of litigation costs between the plaintiff and the defendant,the absence of the obligation of head of administrative organs to appear in court,the conflicts between prohibiting mediation and advocating coordinated resolution,and the weakening of the administrative trial function of the non-centralized jurisdictional court,it is necessary to deeply examine the motivation and effectiveness of the reform,promote the normalization of the convenient trial mechanism,advance the implementation of the legal obligation to appear in court,balance coordination and intervention,emphasize the coordinated development of administrative trial function,and look forward to a better prospect of centralized jurisdiction reform of administrative cases.
