摘要
以所有权和使用权两权分离为基础的宅基地制度,不仅包括一户一宅、一定面积、一次无偿申请,还包括严格的审批与用途管制、“房地一体”的内部转让等基本内容。这些内容体现了宅基地制度在产权分配上鲜明的强弱对比性、申请使用资质上严格的内部限定性、用益物权上明显的残缺性、管理上突出的用途管制性四大特征,集中体现了中国宅基地制度的僵化性。改革僵化的宅基地制度,应以放活为主要方向,以提高宅基地制度的开放性为主要目标,赋予宅基地使用权完整的用益物权和一定的担保物权权能,同时,适度扩大宅基地使用权的市场化流转范围。
The homestead system based on the separation of ownership and right of use also includes one house for one household,a certain area,a free application,strict examination and approval and use control,"house and homestead as one"internal transfer.These contents reflect the four characteristics of the homestead system,namely,the strong and weak contrast in property right allocation,the strict internal limitation in application qualification,the obvious incompleteness in usufructuary right,and the distinct use control proposed in management.These four characteristics centrally reflect the rigidity of the homestead system in China.The reform of the rigid homestead system should focus on allowing flexiblity,enhance the openness of the homestead system,endue the homestead use right with complete usufructuary right and certain real rights for security,and moderately expand the scope of market-based circulation of the homestead use right.
