她们的叙事:中国公司法研究、教学中的性别书写与女性主义再造

Their Narrative:Gender Writing and Feminist Reconstruction in Chinese Corporate Law Research and Teaching

摘要 美国女性主义公司法学派存在明显的"性别导向"现象。女性公司法学者作为一支学术娘子军对公司法研究、教学进行性别改革,领导了公司法研究中的女权运动,并最终创设女性主义公司法这一公司法新兴流派。经验研究表明,中国女性公司法学者中同样存在这种性别导向,她们对公司法进行过功能等值的性别叙事,但她们所处的生态环境并不乐观:人数较少,主要集中在经济发达地区,职称以副教授、讲师为主。并且她们在出色地完成教学任务的同时还承担着大量的事务性工作。经验研究所揭示的现状也为中国公司法研究、教学的女性主义再造提供了改革的作用点:在主体上亟须突围研究者的性别隔离;在观念上需祛魅公司法男性气质;在教学方法上需破除诘问性与对抗性教学手段。 There is an obvious"gender orientation"phenomenon in American feminist corporate law school.Female corporate law scholars carried out gender reforms in corporate law research and teaching,led the feminist movement in corporate law research,and eventually created feminist corporate law,a new genre of corporate law.Therefore,a reasonable assumption is that this gender orientation also exists among Chinese female corporate law scholars.Empirical observations on the research and teaching of contemporary female corporate law scholars in China can not only explore their gender writing,but also reveal gender issues in daily scientific research and teaching from the perspective of female individual and group experience.Studies have shown that Chinese female corporate law scholars have carried out functionally equivalent gender narratives on corporate law,but their ecological environment is not optimistic:the numbers of them is rather small;they mainly concentrate in economically developed areas;their titles are mainly associate professors and lecturers.They perform a large amount of routine work while completing their teaching tasks brilliantly.The status quo revealed by the empirical research also offers an insight of reform for the feminist reconstruction of Chinese corporate law research and teaching:for the main body,it is urgently needed to break through the gender segregation of researchers;in terms of people’s perception,corporate masculinity should be disenchanted;in teaching methods,interrogation and antagonistic parts should be eliminated.
