摘要
作为检察机关内设机构改革的新举措,“捕诉合一”符合机构改革的预期,在提高诉讼效率、提升专业化水平和加强引导侦查能力方面产生了较好的效果。但“捕诉合一”制度中检察官集批准逮捕、提起公诉、诉讼监督职能于一体,容易出现权力过大、错案无法自纠的隐患以及滥用自由裁量权、忽视对逮捕必要性的审查等诸多问题。为了最大程度地发挥“捕诉合一”的功效,应将目光投向检察监督机制,从内部的角度树立以审判为中心的理念、健全检察业务考评机制、完善内部一体化监督机制以及构建检察官职业伦理体系;从外部的角度接受辩护律师全过程的监督、强化当事人的监督、建立逮捕听证程序、引入惩戒主体以及畅通监督渠道,防止权力滥用现象的发生,从而保障“捕诉合一”模式发挥最大的价值。
As a measure of the internal structure reform of the procuratorial organ,“the integration of arrest and prosecution”conforms to the expectation of the structure reform,and has produced good results in improving the litigation efficiency,enhancing the professional level and guiding the investigation ability.However,in the“integration of arrest and prosecution”system,prosecutors are responsible for approving arrest,initiating public prosecution,and supervising litigation.It is easy for prosecutors to have too much power to correct wrong cases,abuse discretion,and neglect the review of the necessity of arrest.To give full play to the effect of“integration of arrest and prosecution”,we should focus on improving the procuratorial supervision and restriction mechanism,and construct the restriction mechanism of internal and external integration.From the internal point of view,we should establish the concept of trial as the center,improve the procuratorial business evaluation mechanism,improve the internal integrated supervision mode and build the professional ethics system of prosecutors.From the external point of view,we should accept the whole process supervision of defense lawyers,strengthen the supervision of the parties,establish the arrest hearing procedure,introduce the external disciplinary subject and smooth the supervision channel to prevent the procuratorial organs from going out of business.In view of the abuse of power,the mode of“combination of arrest and prosecution”should be guaranteed to play its maximum value.
