摘要
BBNJ国际协定谈判的进展受到国际社会的广泛关注。该协定是未来调整各国海洋利益和秩序整合的重要方案之一,涉及海洋遗传资源、海洋保护区制度、环境影响评价制度、海洋治理能力提升与技术转让四个重要领域。目前,BBNJ协定已经进入关键谈判阶段,而我国的渔业产业结构亦在逐步转型,渔业高质量发展已成为关注重点。然而,国家利益博弈、国际渔业冲突和资源养护与经济发展的短期矛盾阻滞了中国参与公海渔业资源养护的步伐。中国应在参与全球海洋治理的整体布局下,积极开展全球渔业资源养护主体多层次的友好合作,促进国际软法在渔业政策执行上的硬法化,全方位构建我国渔业资源治理体系。这不仅有益于中国在BBNJ协定中做出表率,也能推动中国在渔业领域的可持续发展。
The progress of the negotiation of the Biodiversity in Areas Beyond National Jurisdiction(BBNJ)international agreement has received worldwide attention.As one of the important proposals for the interests adjustment and order of the oceans,the agreement involves marine genetic resources,marine protected area system,environmental impact assessment system,marine governance and technology transfer.At present,the BBNJ agreement has entered a critical stage,and the structure of China’s fisheries industry is gradually transforming,and the quality development of fisheries has become a priority.However,the game of national interests,international fisheries conflicts and short-term tension between resource conservation and economic development have hindered China’s participation in the conservation of high seas fisheries resources.China should actively engage in multi-level cooperation among global fisheries resource conservation actors,promote the hardening of international soft law in the implementation of fisheries policy and build China’s fisheries resource governance system in a holistic manner under the overall layout of global ocean governance.This will not only be beneficial for China to set an example in the BBNJ agreement,but also promote China’s sustainable development in the fisheries.
