摘要
本文综合利用宏观数据与中国城市劳动力微观调查数据,考察了劳动力提起劳动争议的基本状况,分析了劳动力提起劳动争议的影响因素。研究发现,劳动报酬和待遇是劳动力提起劳动争议的最主要原因。实证分析表明,劳动力的受教育水平和所在单位的所有制对其是否提起劳动争议具有显著影响。在控制住其他因素的条件下,随着受教育水平的提高,劳动力提起劳动争议的概率逐步提高。与机关事业单位劳动力相比,私营/个体企业和外资/合资企业劳动力提起劳动争议的概率更高。政府需要不断探索更加有效的劳动争议解决机制,进一步贯彻落实好《劳动合同法》。
This paper comprehensively utilizes macro data and micro survey data of China Urban Labor Survey(CULS)to examine the basic situation of labor disputes brought by workers,and analyze the factors influencing labor disputes brought by workers.The study finds that labor remuneration and treatment are the main reasons for labor disputes.Empirical analysis shows that the education level of workers and the ownership of the unit have a significant impact on whether to initiate a labor dispute.Under the condition of controlling other factors,with the improvement of education level,the probability of labor disputes being raised gradually increases.Compared with workers in government agencies and institutions,workers in private/individual enterprises and foreign/joint ventures are more likely to initiate labor disputes.The government needs to continuously explore more effective labor dispute resolution mechanisms and further implement the Labor Contract Law.
