摘要
基于典型案例分析“套路贷”明知的认定问题,结合法教义学方法,贯彻宽严相济的刑事政策,既要遵循《中华人民共和国刑法》总则中明知的规定,又要注意“套路贷”中明知的特殊性,加深对“套路贷”共犯的认识,不断推进法律制度的完善,依法惩罚犯罪,切实保障人权。
Based on the typical cases, this thesis analyzes the identification in “trap loan”, combines the method of legal dogmatic theory, and implements the criminal policy of combining punishment with leniency. We should not only follow the items of the general provisions of the criminal law of the People's Republic of China, but also pay attention to the particularity in “trap loan”, deepen the understanding of “trap loan” related accomplices, constantly promote the improvement of the legal system, and punish crimes according to law to ensure human rights.
